HB 2405 Summary

• Allows hospitals and outpatient surgical centers to offer patients unused portions of facility-provided multidose topical medications (antibiotics, anti-inflammatories, dilation drops, or glaucoma medications) if ordered at least 24 hours before surgery and required for continuing treatment after discharge.

• Requires the prescriber to counsel patients on proper use and administration of facility-provided multidose medications in operating rooms or emergency departments, with pharmacist counseling requirement waived.

• Mandates facility-provided multidose medications be labeled consistent with Title 32, Chapter 18 labeling requirements.

• Defines "facility-provided multidose medication" as topical antibiotic, anti-inflammatory, dilation, or glaucoma medications ordered or retrieved by hospital operating room, emergency department, or outpatient surgical center staff for a specific patient during a procedure or visit.

• Titled the "Topical Medical Waste Reduction Act"; approved by the Governor on March 31, 2025.
