AZ HB2440

Prohibits the Arizona Attorney General from prosecuting or filing civil actions against county board of supervisors members for voting against election canvass certification if based on good faith belief of unresolved integrity issues or presented documentation suggesting irregularities.

Defines "good faith belief" as an honest belief that is not arbitrary, capricious, or driven by partisan motives.

Defines "documentation or other evidence" to include official reports, audits, sworn affidavits, or expert testimony.

Does not prevent the Attorney General from investigating or prosecuting other election-related offenses unrelated to a supervisor's vote against certification.

Effective December 31, 2025.
