HB 2505 Summary

• Repeals Title 11, Chapter 7, Article 8 of Arizona Revised Statutes and sections 13-1509, 13-2928, 13-2929, and 41-1724.

• Removes language from section 13-2319 (smuggling) that allowed peace officers to stop persons based on reasonable suspicion of civil traffic violations and removes language authorizing arrest without warrant for offenses making a person removable from the United States (section 13-3883).

• Eliminates the gang and immigration intelligence team enforcement mission border security subaccount and redirects assessment funds: reduces penalty assessment from $13 to $8 per violation, with $8 going to public safety equipment fund instead of split between that fund and the immigration enforcement subaccount.

• Removes entrapment affirmative defense provisions from sections 23-212 and 23-212.01 (unlawful employment of unauthorized aliens).

• Removes vehicle impoundment provisions related to transporting or harboring aliens in violation of federal immigration law from section 28-3511.
