An association cannot prohibit backyard installation or use of shade structures, including umbrellas, awnings, shade sails, gazebos, pergolas, or canopies.

An association may adopt reasonable rules regarding the size, placement, or appearance of shade structures provided the rules do not prevent installation, impair functioning, restrict use, or adversely affect the cost.

A court shall award reasonable attorney fees and costs to any party who substantially prevails in an action against an association's board of directors for violation of these provisions.
