HB 2763 Summary

• Amends Arizona Revised Statutes Section 38-511 to exclude the federal government and federal agencies from the definition of "any other party" in contract cancellation provisions.

• Allows the state, political subdivisions, and their departments or agencies to cancel contracts within three years if a person involved in initiating, negotiating, securing, drafting or creating the contract becomes an employee, agent, or consultant to another party to the contract.

• Clarifies that "political subdivisions" excludes entities formed or operating under Arizona Title 48, chapters 11, 12, 13, 17, 18, 19, or 22.

• Permits the state and political subdivisions to recoup any fees or commissions paid to persons involved in contract creation when conflict of interest occurs.

• Requires notice of the contract cancellation provision be included in every state and political subdivision contract.
