Department of Gaming shall collect a regulatory assessment from commercial racing permitees in fiscal year 2025-2026, equal to 0.5 percent of amounts wagered on live and simulcast races (both in-state and out-of-state), deducted from pari-mutuel pools.

For race meetings in 2025 and 2026, the Department of Gaming may allow gate approval of tested horses within 60 days of the race in which the horse is entered.

Department of Gaming shall amend administrative code to implement the 60-day gate approval process for tested horses.

The gate approval provision (Section 2) repeals automatically on December 31, 2026.
