HCR 2040 Summary

• Prohibits Arizona government entities from using money or in-kind goods/services from foreign governments or foreign nongovernmental sources for election administration.

• Requires persons or vendors providing election administration services to certify annually under penalty of perjury that they have not knowingly received donations from foreign sources, with updates required within 5 business days of obtaining new information.

• Requires government entities to file quarterly reports with the Secretary of State listing vendors providing election administration services; Secretary of State must post all certifications on their website.

• Prohibits foreign governments and foreign nongovernmental sources from contributing money or in-kind goods/services to influence ballot measure elections, requiring campaign finance filers to certify compliance under penalty of perjury.

• Establishes enforcement mechanisms allowing the Attorney General to seek injunctions and damages of at least $5,000 per violation, and private right of action for qualified electors or state officers to seek injunctions and $1,000 per day in damages for noncompliance; violations constitute a class 1 misdemeanor.
