AZ HCR2042

Proposes amendment to Arizona Constitution Article II, Section 36 to expand and clarify prohibitions on preferential treatment and discrimination based on race, sex, color, ethnicity or national origin in public employment, education, and contracting.

Prohibits compelling applicants, employees, students or contractors to endorse support for preferential treatment or to discuss race-based theories, diversity/equity/inclusion frameworks, or confess race-based privilege.

Restricts public education institutions from spending appropriated funds on positions or offices that promote preferential treatment, including efforts to influence faculty or student composition based on race or ethnicity, and prohibits race-based training or programming.

Includes exceptions for bona fide sex-based qualifications, federal compliance requirements, existing court orders, tribal membership programs, licensed health services, and academic instruction on historical racial injustices.

Requires submission of the proposition to Arizona voters at the next general election.
