SB 1034 Summary

• Allows retired ASRS members who have reached normal retirement age to return to work as prosecutors for the state, county, or city/town while receiving retirement benefits if they waited at least six months after their retirement date before returning to work.

• Defines "prosecutor" to include county attorneys, municipal prosecutors, attorneys general, and their assistant or deputy positions.

• Retired members returning to work as prosecutors are not required to have an employer pay ASRS contributions on their behalf under sections 38-736, 38-737, or 38-797.05.

• Clarifies that retired members returning to work do not accrue credited service, additional account balances, retirement benefits, or long-term disability benefits during their return-to-work period.

• Makes conforming changes to teacher return-to-work provisions by updating references to education code sections (sections 15-540, 15-541, 15-542).
