SB 1035 Summary

• Amends Arizona Revised Statutes Section 13-4041 to modify compensation rates for court-appointed counsel in capital defendant postconviction relief proceedings

• Increases the hourly rate cap for appointed counsel from $100 per hour to a maximum of $200 per hour when approved by the county board of supervisors

• Allows attorneys to file a special action with the Arizona Supreme Court if they believe the court has set an unreasonably low hourly rate or if the court finds hours spent were unreasonable

• Maintains existing requirements that counties request state reimbursement for fees and that total spending in any fiscal year cannot exceed amounts appropriated in the general appropriations act
