SB1039 Summary

• Amends open meeting requirements for condominiums (§33-1248) and planned communities (§33-1804) to require boards that record open meetings to retain recordings for at least six months and make unedited copies available to members upon request.

• Allows members attending association and board meetings to audiotape or videotape open portions without advance notice, unless the board itself records the meeting and provides unedited recordings to members.

• Applies recording retention and availability requirements in compliance with existing records access statutes (§33-1258 for condominiums and §33-1805 for planned communities).

• Maintains existing open meeting policies requiring advance notice to members, published agendas, and opportunities for members to speak before votes are taken.
