Senate Bill 1054 Summary

• Allows assisted living homes and assisted living centers to offer mild hyperbaric oxygen therapy to residents using a Class II chamber registered with the FDA, provided therapy is prescribed by or under direction of a physician and residents can independently exit the chamber.

• Requires therapy to be provided only on physician order and mandates that a trained facility staff member be on-site whenever a resident receives the treatment.

• Requires facilities to provide residents receiving therapy with a notice that the FDA approved the device only for treating mild acute mountain sickness symptoms, that other uses are off-label, and recommending consultation with their physician about personal health risks and contraindications.

• Prohibits offering therapy to residents requiring directed care services unless ordered by the resident's treating physician and the resident or authorized representative provides informed consent.

• Authorizes the Arizona Department of Health Services to adopt rules necessary to implement this section.
