SB 1105 Summary

• Amends distance requirements for nonprofit medical marijuana dispensaries and marijuana establishments to prohibit location within 500 feet of public or private schools, child care facilities, or facilities providing preschool programs.

• Modifies section 36-2804 to add child care facilities and preschool program facilities to the list of protected locations for nonprofit medical marijuana dispensaries.

• Adds new section 36-2857 establishing local government authority to regulate marijuana establishments and testing facilities through zoning, limits on numbers, operational restrictions, and signage regulations.

• Prohibits localities from enacting regulations more restrictive than those applied to nonprofit medical marijuana dispensaries or from preventing dual licensees from operating dispensaries and marijuana establishments cooperatively at shared locations.

• Applies only to nonprofit medical marijuana dispensary registration certificates and marijuana establishment licenses issued on or after the effective date and requires a three-fourths vote in each house of the legislature for enactment.
