SB1232 Summary

• Amends Arizona Revised Statutes Section 13-3897 regarding arrest warrants and procedures following arrest.

• Magistrate shall issue an arrest warrant if satisfied by sworn or affirmed affidavit that probable cause exists that a felony offense was committed and a particular person committed it.

• Expands where arrested persons can be taken: officer may bring arrestee before the magistrate who issued the warrant, or if that magistrate is unavailable, before the nearest or most accessible magistrate in the same county or a magistrate in the county where the offense occurred.

• Removes prior language restricting the provision to arrests made in the county where the offense was committed and warrant was issued, allowing greater flexibility in multi-county situations.
