SB 1234 Summary

• Adds new misdemeanor offense for intentionally, knowingly or recklessly failing to provide medical attention necessary to prevent unreasonable suffering to any domestic animal under a person's custody or control.

• Expands the definition of "cruel neglect" to require domestic animals receive food appropriate for the species and fit for consumption, suitable drinking water, and adequate shelter with specific structural requirements for outdoor dogs.

• Increases penalties by classifying violations of subsection A, paragraphs 1, 2, 3, 4, 5, 6, 7, 12, 16, and the new paragraph 17 as class 1 misdemeanors.

• Refines outdoor dog shelter requirements to include natural or artificial cover, structurally sound construction, adequate size for the dog to stand and lie down, and maintenance to minimize disease and parasites, with exceptions for dogs engaged in hunting, police work, or under control of homeless individuals.

• Adds "bird, reptile or amphibian" to the definition of "domestic animal" to expand cruelty protections beyond mammals.
