SB 1337 Summary

• Requires written violation notices from condominium and planned community associations to include the provision allegedly violated, date of violation, and process to contest the notice.

• Allows unit owners and members to request the first and last names of persons who observed the violation, which associations must provide in compliance with disclosure requirements.

• Requires associations to include in violation notices that members may petition for a hearing before the state real estate department pursuant to section 32-2199.01.

• Prohibits associations from enforcing violations or collecting attorney fees until providing required information and allowing members time to request and receive observer names.

• Applies similar notice and disclosure requirements to both condominium associations (section 33-1242) and planned community associations (section 33-1803).
