Senate Bill 1353 Summary

• Requires municipalities with 30,000+ residents to approve, conditionally approve, or respond to single-family residential building permit applications within 15 working days after construction documents and vertical construction activities are approved, or allow qualified third-party review of the application.

• Mandates municipalities maintain a list of at least three eligible third-party reviewers to perform building permit application reviews when the 15-day deadline is not met.

• Prohibits municipalities from requesting or requiring applicants to waive deadlines or procedures required by the third-party review process.

• Grants immunity to municipalities that issue permits, approvals, or certificates of occupancy after third-party plan review in accordance with sections 12-820.01 and 12-820.02.

• Exempts applications subject to hillside development ordinances or federal floodplain regulation reviews from the third-party review requirements, and excludes certificates of occupancy and subdivision preplats from the definition of "application."
