SB 1398 Summary

• Expands who can perform medication abortions by allowing nurse practitioners and physician assistants (in addition to physicians) to provide abortion services, subject to regulatory requirements.

• Prohibits physician assistants from performing surgical abortions and from prescribing medication intended to induce abortion.

• Removes the 24-hour waiting period requirement before abortion procedures and before providing informed consent information.

• Updates abortion clinic regulations and reporting requirements to reflect that nurse practitioners and physician assistants may now perform certain abortion procedures under the direction of the medical director.

• Repeals section 36-3604 relating to existing abortion restrictions and updates definitions throughout statutes to include nurse practitioners and physician assistants as authorized abortion providers.
