Prohibits state and political subdivisions from establishing policies or practices requiring employees to be hired based on anything other than merit.

Prohibits manipulation or influence of employee composition with reference to race, ethnicity, sex, or national origin, except to ensure color-blind and race-neutral hiring in compliance with state and federal antidiscrimination laws.

Allows the attorney general, county attorneys, or any person to file for declaratory relief, injunctive relief, or damages for violations; prevailing parties are entitled to costs and reasonable attorney fees.

Defines "merit" as an employee's qualifications, skills, knowledge, experience, and demonstrated ability to perform essential job duties, determined through objective criteria including education, training, work history, job performance, and relevant assessments.

Clarifies that the section does not contradict existing state or federal employment laws prohibiting discriminatory practices.
