Senate Bill 1621 Summary

• Adds new sentencing provision (subsection H) requiring mandatory sentences of 10-25 years (minimum 10 years, presumptive 16 years, maximum 25 years) for selling a narcotic drug that contributes to another person's death.

• Establishes enhanced sentencing for fentanyl sales of 200+ grams: first offense 5-15 years (minimum 5, presumptive 10), repeat offense 10-20 years (minimum 10, presumptive 15).

• Allows presumptive sentences under the fentanyl and death provision to be mitigated or aggravated pursuant to existing sentencing guidelines in section 13-701.

• Officially designates this legislation as "Noah's Law."

• Does not modify existing classifications or penalties for other narcotic drug violations under subsection A.
