Director of the Department of Corrections may release inmates from custody to nursing care institutions if they suffer from a terminal condition or disease requiring palliative or end-of-life care.

Director may also release inmates who are so debilitated or incapacitated by terminal conditions that they require continuous care or cannot physically present a danger to themselves or others.

Director must periodically review medical records of released inmates to verify they continue meeting eligibility requirements and must return inmates to custody if they no longer qualify.

Inmates convicted of first-degree murder under Arizona Revised Statutes section 13-1105 are ineligible for release under this provision.

"Nursing care institution" is defined as a facility meeting the definition in section 36-401 that holds a contract with the state or the Department of Corrections.
