Upgrades criminal trespass charges from third degree to first degree for tenants who remain in or return to a property after being lawfully served with a writ of restitution following an eviction judgment.

Changes the applicable criminal statute from section 13-1502 (third degree trespass, a class 3 misdemeanor) to section 13-1504 (first degree trespass, a class 1 misdemeanor).

Applies to dwelling units, mobile home spaces, and recreational vehicle spaces where the person lacks express permission from the property owner or person with lawful control.

Maintains existing requirements that writs of restitution cannot be issued until five calendar days after judgment and must be enforced promptly without delays from motions to set aside judgment.
