Municipalities and counties in the Prescott Active Management Area would be prohibited from approving building permits for multifamily residential properties unless the applicant demonstrates an assured water supply through a certificate from the Department of Water Resources or a commitment from a designated water provider.

Multifamily residential property is defined to include traditional multifamily developments and "residential lease communities" of six or more detached dwelling units offered for lease under a common promotional plan.

Applicants who applied for or received zoning entitlements before the bill's effective date are exempt from the new requirements.

The bill amends existing assured water supply law to require that proposed groundwater withdrawals for multifamily properties in the Prescott area not exceed depths of 1,000 feet or the aquifer bottom over a 100-year period.

Agricultural worker housing on agricultural property is specifically excluded from the definition of residential lease community and these requirements.
