Homeowners' associations in planned communities cannot prohibit the backyard installation or use of shade structures under this amendment to Arizona Revised Statutes.

HOAs may adopt reasonable rules regarding the size, placement, or appearance of shade structures, provided such rules do not prevent installation, impair functioning, restrict use, or adversely affect cost.

Any HOA rules on shade structures cannot be more restrictive than the municipal zoning ordinances for shade structure height and setbacks applicable to single-family homes in that city or town.

"Shade structure" is defined as a commercially produced or professionally manufactured moveable or permanent structure designed to protect an area from sunlight, including umbrellas and shade sails.
