Counties may not prevent, restrict, or regulate the construction and operation of small modular nuclear reactors if specific federal and local requirements are met before construction begins.

Small modular reactor operators must voluntarily obtain an early site permit from a federal nuclear regulatory agency and complete the required public notice and comment process under 10 CFR Part 52.

The small modular reactor design must receive federal design certification under 10 CFR Part 52 before construction can proceed.

Operators must submit evidence to the county board of supervisors demonstrating completion of the public comment period, receipt of the early site permit, and design certification for the reactor.

The bill amends Arizona Revised Statutes section 11-812 relating to county zoning to add small modular reactors to the list of uses that counties cannot restrict through zoning ordinances.
