Creates a new cause of action allowing students or parents to sue public schools for damages when a student suffers serious physical injury from bullying by another student

Requires three conditions for liability: the student suffered serious physical injury from bullying, the school received at least one prior report of bullying by the same student against the victim, and the school negligently failed to address the reported bullying

Defines "prior report" broadly to include written or verbal reports to any school employee, as well as a school employee's personal observation of conduct they reasonably believe constitutes bullying

Applies to reports made to any school employee, including those indirectly employed through third-party contractors

Allows courts to award reasonable attorney fees, expenses, and damages to claimants who substantially prevail in such actions
