Requires qualified schools accepting ESA funds to ensure all teaching staff and personnel with unsupervised student contact be at least 18 years old, fingerprinted, and not subject to state board disciplinary action for immoral or unprofessional conduct.

Applies the same age and disciplinary requirements to individuals and facilities providing tutoring or teaching services funded by ESA accounts.

Mandates the State Board of Education adopt safety rules requiring qualified schools to comply with fire, safety, and food sanitation codes; secure heavy machinery, tools, and weapons; install pool enclosures; and prohibit illegal drugs or alcohol on premises.

Authorizes the State Board of Education to adopt rules promoting financial transparency for qualified schools and ensuring ESA funds are used only at schools and tutoring providers meeting the new personnel requirements.

Removes the provision stating that in legal proceedings, the state bears the burden of proving laws applied to qualified schools are necessary and not unduly burdensome.
