AZ SB1704

SB1704 requires qualified schools receiving Empowerment Scholarship Account (ESA) funds to notify parents in writing of the specific special education services and therapies they will provide to students with disabilities before enrollment and payment of tuition.

Qualified schools must provide all accommodations and services required under a student's Individualized Education Program (IEP) or Section 504 plan, unless the parent or student provides a written waiver.

Students with disabilities whose qualified school fails to provide required accommodations or obtain a waiver may transfer and receive a prorated refund of tuition and fees for the unused portion of the school year.

The bill expands oversight of ESA-participating private schools specifically for students who qualify based on disability criteria under Section 15-2401, paragraph 7, subdivision (a), items (i), (ii), or (iii).
