AB 1140 Summary

• Prohibits the Bureau for Private Postsecondary Education from enforcing regulations against flight instruction institutions and Federal Aviation Administration certified aircraft maintenance programs from July 1, 2010 to July 1, 2011, with those institutions required to notify the bureau if operating during this period.

• Requires institutions offering unaccredited doctoral degree programs to disclose to prospective students that the degree is unaccredited and any known limitations, including whether the degree is recognized for licensure or certification in other states.

• Authorizes the bureau to publish its own list of acceptable entrance examinations for ability-to-benefit students if the United States Department of Education does not have relevant examinations for the intended occupational training.

• Changes the refund deadline for student cancellations from the 7th class day after enrollment to the 7th day after enrollment, and revises the definition of "graduates employed in the field" to focus on skills utilized to perform the position's purpose or major responsibilities rather than providing a significant advantage.

• Appropriates $580,000 for five permanent, full-time private postsecondary education specialist and senior specialist positions at the bureau and declares the act an urgency statute effective immediately.
