AB 1449 Summary

• Requires agents, brokers, solicitors, and sales representatives assisting applicants with individual health care service plan contracts or health insurance policies to attest that application information is complete and accurate and that they explained the risks of providing inaccurate information to the applicant

• Imposes a civil penalty of up to $10,000 for persons who willfully make false statements in required attestations, enforceable through civil action by any public prosecutor

• Directs civil penalties collected from health care service plan violations to the Managed Care Administrative Fines and Penalties Fund instead of the general Managed Care Fund

• Directs civil penalties collected from health insurance policy violations to the Insurance Fund

• Requires individual health care service plan and health insurance policy applications to include statements advising applicants of the civil penalty for false attestations
