AB 1603 Summary

• Extends temporary partial disability benefits for up to 60 days after an employee is medically cleared to return to work (permanent and stationary status) if the employer has not yet offered regular, modified, or alternative work

• Requires employers to either offer work or explicitly inform employees that work will not be available within the 60-day window, or employees continue receiving temporary disability payments

• Defines the effective date of a work offer as the first day the employee would begin working if accepted immediately upon receipt

• Establishes that notice to employees is deemed received on the earlier of actual receipt or five days after mailing to the employee's last known address

• Specifies that weekly loss of wages for this temporary partial disability period shall be calculated under existing Section 4657 formulas, excluding calculations based on proportionate loss of physical ability or earning power
