AB 1763 Summary

• Requires criminal background checks for In-Home Supportive Services (IHSS) providers through the Department of Justice, with checks completed by July 1, 2010 for existing providers.

• Removes applicants' right to formally challenge inaccurate criminal background information and to waive fees for obtaining criminal history records.

• Requires public authorities, nonprofit consortia, and counties to provide individuals denied IHSS provider placement with a copy of their criminal offender record information search response while protecting confidentiality and privacy.

• Permits two or more adjacent counties or their public authorities/nonprofit consortia to designate one entity to conduct criminal background checks and maintain common lists of eligible IHSS providers.

• Establishes state reimbursement procedures for any local costs mandated by the bill and declares the act as an urgency statute effective immediately.
