Adds exemption allowing employers to alter, reduce, or eliminate health benefits or health care reimbursement plans for retired persons when they become eligible for Medicare benefits, effective January 1, 2011.

Applies the Medicare eligibility exemption to all retiree health benefit plans and contractual provisions concerning retiree health benefits and health care reimbursement plans in effect on or after January 1, 2011.

Clarifies that this exemption does not violate the Fair Employment and Housing Act's age discrimination protections.
