AB 2035 Summary

• Requires administrators of self-funded dental benefit plans to provide written notice to claimants when an adverse benefit determination is made on a claim, including notification of the right to appeal and the appeal process.

• Mandates that the notice inform claimants that the dental benefit plan is subject to the federal Employee Retirement Income Security Act of 1974 and is not subject to state law governing dental health care coverage.

• Applies only to administrators providing services for self-funded dental benefit plans that are subject to federal jurisdiction.

• Establishes that these requirements constitute a regulation of insurance under federal law (29 U.S.C. Section 1144) and conform to federal notice requirements under 29 CFR Section 2560.503-1(g).
