AB 2139 - California Product Stewardship Act

• Establishes the California Product Stewardship Act requiring producers of covered products to submit product stewardship plans to the Department of Resources Recycling and Recovery within one year of a product's designation as "covered."

• Requires the department to recommend consumer products for inclusion as covered products by January 1, 2012, based on environmental, waste management, and public health impacts.

• Mandates product stewardship plans include collection rates, reuse and recycling rates, performance goals, product design improvements, and education/outreach strategies addressing the product's entire life-cycle.

• Prohibits producers from selling covered products six months after their stewardship plan is deemed complete by the department unless the plan is approved; department must post non-compliant products on its website.

• Establishes annual fees set by the department to cover administration costs, with penalties up to $5,000 per day for non-compliance; creates the Product Stewardship Account and Penalty Subaccount in the Integrated Waste Management Fund.
