Applies to both individual and group health care service plan contracts and health insurance policies covering prescription drugs.

Exempts publicly funded state health care coverage programs (Medi-Cal, Healthy Families Program) and Medicare supplement contracts from this requirement.

Makes willful violations by health care service plans a crime under the Knox-Keene Health Care Service Plan Act of 1975.

Specifies that no state reimbursement to local agencies or school districts is required because costs result from creating new criminal penalties.
