AB 2176 Summary

• Establishes the California Lighting Toxics Reduction and Jobs in Recycling Act requiring producers of class 1 lamps (mercury-containing lamps) to submit product stewardship plans by September 30, 2011, for approval by the Department of Toxic Substances Control.

• Requires class 1 lamp producers to implement approved plans by January 1, 2012, establishing collection systems, recycling programs, and education efforts with the goal of recycling all unwanted class 1 lamps, including orphan lamps, by January 1, 2020.

• Requires class 2 lamp producers (lamps producing fewer than 45 lumens per watt) to pay an annual fee to the State Energy Resources Conservation and Development Commission beginning January 30, 2012, with fees deposited into the Energy Efficiency Research Fund for lighting efficiency research and environmental impact reduction.

• Prohibits producers, wholesalers, and retailers from selling class 1 lamps on or after January 1, 2012, unless the producer participates in an approved stewardship program, and class 2 lamps on or after February 1, 2012, unless the producer has paid the required fee.

• Establishes the Lighting Product Stewardship Subaccount in the Hazardous Waste Control Account to fund department costs for reviewing and enforcing product stewardship plans.
