Prohibits packaging or labeling consumer products as "flushable," "sewer and septic safe," or similar terms for sale in California on or after January 1, 2012, unless the product meets acceptance criteria published in the INDA Guidance Document for Assessing the Flushability of Nonwoven Consumer Products as it exists on January 1, 2012

Requires manufacturers who label products as flushable to maintain written documentation that testing substantiates the claim and that the testing was performed by a qualified laboratory capable of performing the specified acceptance criteria testing

Exempts wholesalers and retailers who do not initiate the flushable representation through advertising or package labeling from these requirements

Requires laboratories performing flushability testing to undergo annual quality assurance and quality control audits beginning January 1, 2015

Establishes violations punishable by a fine of up to $2,500
