Authorizes community college districts to set nonresident tuition fees using one of four formulas, including one based on the average of nonresident tuition fees at public community colleges in at least 12 states with comparable cost of living.

Allows districts to maintain nonresident tuition fees at current or prior-year levels when formula-calculated amounts fall below historical rates.

Requires additional revenue from increased nonresident tuition to be used for expanding and enhancing services to resident students, with a prohibition on nonresident admissions coming at the expense of resident enrollment.

Removes the requirement that governing boards consider nonresident tuition fees of public community colleges in other states when setting fees.

Mandates the Chancellor's Office provide data on resident and nonresident enrollment, tuition rates, and revenue to the Legislative Analyst's Office for annual budget analysis, commencing with the 2009-10 academic year.
