AB 2324 Summary

• Makes it a misdemeanor to knowingly possess firearms, imitation firearms, explosives, and other specified weapons in sterile areas of public transit facilities if notice is posted, punishable by up to six months in county jail and/or up to $1,000 fine.

• Applies existing airport/passenger vessel terminal prohibitions to public transit facilities, including unauthorized entry into restricted areas and intentionally avoiding security screening, with enhanced penalties for violations resulting in evacuations or delays.

• Recasts transit passenger misconduct penalties: eating/drinking, smoking, and skateboarding are infractions on first or second offense but become misdemeanors on third or subsequent offense; fare evasion and equipment tampering are misdemeanors.

• Changes possession of explosives, acids, and flammable liquids in public transit vehicles from infraction to misdemeanor status with criminal penalties.

• Requires state to provide no reimbursement to local agencies for costs related to creating new crimes, eliminating crimes, or changing penalties as authorized under state constitutional provisions.
