Extends permanently the ability for special absentee voters temporarily living outside the United States, District of Columbia, or called to military service to return ballots by facsimile transmission (previously set to expire January 1, 2011)

Requires voters returning ballots by facsimile to sign an oath declaring they have waived their right to a secret ballot and have not applied for vote by mail ballots from any other jurisdiction

Mandates elections officials compare signatures on facsimile-returned materials with signatures on voter registration affidavits to determine voter eligibility

Specifies facsimile ballots must be received by the close of polls on election day and be accompanied by an identification envelope and completed oath of voter declaration

Establishes that no state reimbursement is required for costs related to new or changed criminal penalties, but other state-mandated costs shall be reimbursed per Government Code procedures
