AB 2396 Summary

• Requires designated statistical agents to conduct public meetings on pure premium rates, classifications, rating plans, and related matters, with call-in access and electronic recording allowed for teleconference meetings.

• Specifies that certain records of designated statistical agents are public, including bulletins, meeting agendas/minutes, rating filing information, actuarial assumptions, and aggregate data summaries, but prohibits disclosure of individual insurer data, claims data, payroll data, and medical data.

• Mandates that rating organizations provide experience rating information by electronic means directly to information services companies that were in the business of publishing or providing such information before September 15, 1989, and to advisory organizations on a timely basis at the direct cost of duplication.

• Requires rating organizations to make experience rating information available to any information services company furnishing workers' compensation information to insurers, agents, or brokers, subject to written statement requirements and restrictions on use.

• Prohibits rating organizations from entering into contracts or agreements that prevent information services companies from receiving and providing experience rating information.
