AB 2398 Summary

• Requires carpet manufacturers to submit stewardship plans to the Department of Resources Recycling and Recovery by September 30, 2011, with goals to increase recycling and diversion of postconsumer carpet from landfills.

• Establishes a carpet stewardship assessment of $0.05 per square yard starting July 1, 2011, and a variable assessment beginning January 1, 2013, to fund recycling programs and recovery efforts.

• Designates the Carpet America Recovery Effort (CARE) as the sole stewardship organization until April 1, 2015, after which manufacturers can establish their own organizations.

• Requires the Department of Resources Recycling and Recovery to maintain a public list of compliant manufacturers and imposes civil penalties of up to $1,000 per day (or $10,000 per day for intentional violations) for noncompliance.

• Establishes the Carpet Stewardship Account and Penalty Subaccount in the Integrated Waste Management Fund to collect fees and penalties for program administration and enforcement.
