AB 2490 Summary

• Requires any dispute resolution agreement (including arbitration clauses) between California employers and workers' compensation insurers to be filed with the rating organization and provided to employers with written quotes

• Mandates that dispute resolution provisions must specify California law governs disputes arising in California and identify California as the proper venue for proceedings

• Allows employers and insurers to freely negotiate and agree to alternative choice of law or forum provisions before the policy takes effect

• Voids and renders unenforceable any dispute resolution provision that fails to comply with these requirements
