AB 2535 Summary

• Requires the California Earthquake Authority to make all nonproprietary materials and documents available in electronic form in which the authority holds or uses the information for ratemaking determinations and findings of necessity.

• Requires the authority to make nonproprietary materials and documents used to determine the necessity for modifying entry requirements available electronically to the public at no charge.

• Allows the board to open authority participation to insurers without capital contribution requirements if they maintain or exceed residential property insurance policies held as of January 1, 1996, creating "associate participating insurer" status.

• Restricts associate participating insurers from canceling or refusing to renew residential property insurance policies solely because insured accepted earthquake coverage, with limited exceptions for underwriting principles, solvency concerns, and reinsurance changes.

• Subjects associate participating insurers to the same assessment obligations and authority plan of operation as regular participating insurers, with violations enforceable under the Unfair Trade Practices Act.
