Requires state agencies conducting adjudicative proceedings to provide by regulation for peremptory challenge of presiding officers who are administrative law judges.

Authorizes (but does not require) state agencies to provide by regulation for peremptory challenge of presiding officers who are not administrative law judges.

Exempts agencies that have conducted more than 1,000 scheduled proceedings in each of the last three fiscal years from the peremptory challenge requirement.

Exempts agencies that have a system of reconsideration and review of disqualification denials where the challenged administrative law judge does not participate in the disqualification decision.
