Requires the California Emergency Management Agency (Cal EMA) to adopt regulations by January 1, 2013, mandating that public water systems and wastewater treatment plants consider using safer technologies in their Risk Management Plans (RMPs).

Defines "safer technology" as technologies, products, raw materials, or practices that significantly reduce or eliminate the release of hazardous raw materials used in water treatment and associated public health and environmental hazards.

Requires water systems and wastewater treatment plants to utilize safer technology chemical products in their RMPs if the products are appropriate for their disinfection methodology, commercially available, and chosen based on comparison of safety and environmental effects.

Specifies that regulations cannot require goods or services that perform inadequately, exclude adequate competition, or are unavailable at reasonable prices.

Declares no state reimbursement is required because the bill creates a new crime under the California Accidental Release Prevention (CalARP) program, falling within an exemption under the California Constitution.
