Creates the California Nursery Producers Commission with 14 producer members elected by district and one public member, authorized to conduct research, education, promotion, and marketing programs for nursery products.

Commission may levy annual assessments not exceeding $0.006 per dollar of gross sales on nursery producers (those with sales over $2.5 million) to fund operations.

Requires approval by referendum with at least 40 percent producer participation and either 65 percent approval with majority sales value, or simple majority with 65 percent sales value, before becoming operative.

Establishes confidentiality protections for proprietary business information and trade secrets submitted to the commission, with limited exceptions for court-ordered disclosure.

Grants commission authority to enforce compliance through civil penalties up to $1,000, civil actions for collection of assessments, and injunctive relief; includes five-year reapproval requirement and suspension procedures.
