AB 2772 Summary

• Requires employers appealing Labor Commissioner decisions to post a bond with the court in the amount of the judgment before filing an appeal in superior court.

• Bond may be posted as either a surety appeal bond from a licensed surety or a cash deposit with the court.

• If the employer fails to pay the judgment amount within 10 days after the appeal is dismissed, withdrawn, or decided, the bond is forfeited to the employee.

• Unsuccessful appellants must pay court-determined costs and reasonable attorney's fees incurred by the other parties as a cost of the appeal.
