AB 346 Summary

• Extends authority for school districts and county superintendents to designate a single entity to perform criminal background checks and maintain employment lists for noncertificated candidates assuming paid or volunteer positions in multiple districts within a county or contiguous counties.

• Requires noncertificated candidates to obtain an Activity Supervisor Clearance Certificate from the Commission on Teacher Credentialing before assuming paid or volunteer positions working with pupils in school district-sponsored pupil activity programs, effective July 1, 2010.

• Exempts volunteer supervisors for breakfast, lunch, or nutritional periods and nonteaching volunteer aides (including parents volunteering in classrooms or on field trips and community members providing noninstructional services) from the clearance certificate requirement.

• Exempts candidates from the clearance certificate requirement if the school district requires them to clear a Department of Justice and Federal Bureau of Investigation criminal background check prior to beginning their activities.

• Takes effect immediately as an urgency statute to ensure noncertificated candidates are screened for criminal background checks at the earliest possible time.
